As Mlalazi moved closer to inquire what was happening, he found the accused person seated behind the shop and as he was inquiring about the odd trading hours, the accused became angry and picked a stone and hit him once on the head and Mlalazi lost consciousness and fell on the ground.
“The accused choked the complainant with his right hand while lying on the ground and was rescued by his colleague.”
According to the medical affidavit presented as evidence, the accused sustained bruises and scratches.
