The trial of 65 accused persons, including former Citizens Coalition for Change (CCC) senator Jameson Timba who were discharged yesterday on the second count of disorderly conduct, resumes today.
The accused persons are facing charges of participating in a gathering with the intent to promote violence, breaches of peace, or bigotry.
Yesterday, the court discharged all 77 accused persons on the second count of disorderly conduct.
“All accused persons were discharged on the second count of “disorderly conduct,” the National Prosecuting Authority said in a statement on X.
“Accused persons 10,11,21,22,25,37,45,49,30,20 and 61 were discharged at the close of state case on the first count of “participating in a gathering with the intent to promote violence breaches of peace or bigotry”.
The state alleges that on June 16, police received information about an unsanctioned gathering at a house in Strathaven, Harare, which was allegedly an unlawful demonstration.
When police officers inquired about the purpose of the gathering, the accused persons became hostile and riotous, throwing stones at the police and their vehicle.
Two police officers were injured, and the police vehicle was damaged.
The trial will continue today, with the prosecution expected to present its case against the remaining accused persons.
In a separate development, Sean Timba, who was among the 77 discharged accused persons was also discharged on both charges as the courts said he was a victim of the crossfire.
