A 27-year-old Victoria Falls man has been sentenced to an effective five months in prison after assaulting another man with a beer bottle at a Chinotimba bar.
Marko Chishava appeared before Victoria Falls magistrate Fungai Dzimiri and pleaded guilty to assaulting 41-year-old Mavuto Nyathi.
According to the State, the incident occurred on 8 August 2026 at around 8 p.m. at a Chinotimba old bar club.
The court heard that Nyathi was drinking beer when Chishava assaulted him by striking him once on the forehead with a Black Label beer bottle.
The State said the assault was committed for no apparent reason.
Nyathi was not medically examined following the attack.
Chishava was charged with assault as defined in Section 89(1)(a) of the Criminal Law (Codification and Reform) Act, Chapter 9:23. The law requires a court, when determining sentence for assault, to consider factors including the degree of force used and whether a weapon was involved.
After pleading guilty, Chishava was sentenced to two monthsβ imprisonment for the latest assault.
However, the sentence did not end there.
The court record shows that Chishava had previously been convicted of a similar assault under Victoria Falls court record VF 55/2026.
In that earlier matter, he had received a suspended sentence of three months, suspended for five years on condition that he did not commit a similar offence.
By committing another assault during the five-year suspension period, Chishava breached the condition of the earlier sentence.
The court therefore activated the three months that had previously been suspended.
This brought his effective sentence to five months in prison β two months for the latest assault and three months activated from the previous case.
The latest matter was recorded under Victoria Falls court record VF 477/2026.
Chishava was prosecuted by Cynthia Mayibongwe Makhaya.
